PASSION 4 (UK) LTD – TERMS AND CONDITIONS
GENERAL HIRE TERMS
Hired equipment will remain the property of Passion 4 (UK) Ltd at all times.
During the period of hire, the Hirer is solely responsible for the hire goods and must insure against all risks.
The Hirer undertakes to keep the hired goods in excellent order and condition and to return all equipment to Passion 4 (UK) Ltd in such order and condition.
Stickers and branding cannot be used without the prior permission of Passion 4 (UK) Ltd.
Nothing can be attached to the furniture / machines without the permission of Passion 4 (UK) Ltd.
DELIVERY / INSTALLATION / REMOVAL
Passion 4 (UK) Ltd will endeavour wherever possible to ensure that pre-agreed delivery and collection times are adhered to. However Passion 4 (UK) Ltd cannot accept responsibility for late deliveries or collections, due to any unforeseen circumstances.
Unless otherwise agreed in writing the hired equipment will be delivered to a ground floor location. Should the event space require access via a lift or stairs this should be advised by the hirer prior to delivery, and may be subject to an additional charge. Passion 4 (UK) Ltd reserves to right to refuse installation of the hired equipment should it feel the location is not suitable / safe to do so.
Once on location the hired equipment cannot be moved from one site to another by the hirer.
An additional charge may apply for wait time if a site is not available for set up at the time stated for delivery.
An additional full-day hire fee may apply if items are not ready for collection on the date / time stated on the booking confirmation.
In the event of any equipment requiring repair as a result of the Hirer’s negligence, misuse or abuse, then the hirer shall bear the cost of any such repair.
In the event that the goods are damaged beyond economical repair, or are lost, the hirer shall bear the full write-off cost. The hirer shall report to Passion 4 (UK) Ltd in writing within 48 hours of the event, any damage to or loss of equipment. Write-off costs for each product are available upon request.
All performers will assess the site on arrival and provide a risk assessment to the client identifying any possible risks/dangers in relation to their performance.
Passion 4 (UK) Ltd ensures all performers hold their own public liability insurance.
The client agrees to provide a suitable, dry, clean and private changing area for all performers, with access to a toilet, full length mirror, and supply of bottled water/soft drinks for the duration of the performers’ time at the hirer’s event.
All temporary staff (hereinafter referred to as the freelancer) agree that they will be working under a self employed status contract are not entitled to sick pay, holiday pay or any form of employment protection other than work place Health & Safety.
For the purposes of clarity, both the company and the freelancer consider and intend this business relationship to be one of self employment and not one of master and servant.
Specifically, both parties acknowledge that the contract for services does not give rise to a contract of employment.
The freelancer is responsible for their own tax and National Insurance.
10 YEARS VOUCHER SPECIFIC
If you’ve received one of our ‘celebrating 10 years’ vouchers, the following terms and conditions apply:
– No minimum spend
– No cash equivalent
– Valid on new event bookings only and can not be redeemed against existing bookings
– One voucher valid per person
– One voucher valid per event
– Vouchers can not be used in conjunction with any other offer or already discounted package
CANCELLATION / NON PAYMENT POLICY
Once accepted & signed, our booking confirmation becomes a contract and is thus subject to a cancellation fee as follows:
– Cancelled between 6 & 12 months of the event – 10% of hire charge
– Cancelled less than 6-months & more than 28-days of the event – 50% of hire charge
– Cancelled less than 28 days & more than 14-days of the event – 75% of hire charge
– Cancelled less than 14 days of the event – 100% of hire charge
This cancellation policy applies to hire items only. Any custom, printed, or bespoke items are non-refundable. Management and design fees will be calculated on a pro-rata basis, based on how much work has been carried out to date.
You will indemnify us against any and every expense, financial loss, claim or proceedings whatsoever or damage to or loss of property arising out of the delivery, use, non-use, repossession, collection or return of the equipment or any part of it.
In accordance with late payment legislation, our company charges debt recovery costs and interest on late payments (the Bank of England Reference rate plus 5%). This means that interest will continue to accrue daily on your outstanding debt from the date the debt became due.
We will be entitled at any time if you break this contract or if any proceedings are commenced in which your solvency is called into question we will be entitled at any time to terminate this contract with immediate effect and to repossess any or all of the equipment. Such termination will affect our right to recover from you any money due to us under this contract or damages for breach of contract.
You authorise us as your agent to enter any land or premises where we believe any equipment to be, in order to inspect or repossess it.
Any failure by us to enforce any or all of these conditions shall not amount to, or be interpreted as a waiver of any of our rights.
Should any of our machines breakdown over the course of your event, or an item of furniture arrive damaged due to no fault of the client or their guests, Passion 4 (UK) Ltd will refund this machine(s)/item(s) on a pro-rata basis.
Passion 4 (UK) Ltd accepts no responsibility for any injuries or claims whilst using Passion 4 (UK) Ltd’s hired equipment / performers.
Passion 4 (UK) Ltd reserves the right to substitute any goods for appropriate alternatives in the event that the actual goods quoted for are not available.
Acceptance of quotations must be in writing by fax / post or scanned via email attachment.
Settlement of the account is strictly prior to delivery unless otherwise agreed in writing by Passion 4 (UK) Ltd. 100% of the agreed price must be forwarded with the Hirer’s order to allocate stock and confirm your booking. At the very latest this payment must be made 10 working-days for cheques, 2 working-days for BACS prior to hire commencement.
